TERMS AND CONDITIONS OF SERVICE β€” YEO CARGO LLC

DEFINITIONS

  1. YEO CARGO LLC: a company registered in the United States whose business purpose includes, without limitation, international courier service by air and sea through a consolidated cargo system, for the delivery of parcels and packages lawfully purchased by its CUSTOMERS from EXTERNAL SUPPLIERS OR INDEPENDENT SELLERS, or shipped directly by the CUSTOMER to a third party, to be delivered to them or to duly authorized third parties, at its offices or at a residential address. This activity is governed by applicable international treaties and conventions, the customs regulations of the United States and the destination countries (including Venezuela and Colombia), and other applicable legal instruments.
  2. EXTERNAL SUPPLIER OR INDEPENDENT SELLER: any individual or legal entity unrelated to YEO CARGO LLC from which the CUSTOMER buys, acquires, or requests products and services, with no ownership, economic, or business relationship to YEO CARGO LLC.
  3. COURIER CARGO: the operation through which YEO CARGO LLC, or the operator it designates, transports consolidated cargo under its own name or that of its logistics partners, destined for third parties, using contracted transportation and its own packaging.
  4. PARCEL: a shipment of goods in packages, within or outside the country of origin, consigned to YEO CARGO LLC's offices to be delivered to the designated agency or to the address chosen by the CUSTOMER.
  5. WEBSITE: https://yeocargo.com, which contains information about YEO CARGO LLC's services and rates.
  6. PASSWORD: a set of characters that allows the CUSTOMER to access their account or mailbox.
  7. USERNAME: the identifier used by the CUSTOMER to access their account, generally accompanied by a password created at the time of registration.
  8. TRACKING NUMBER: the identification number provided by the EXTERNAL SUPPLIER to track the package from its origin to YEO CARGO LLC's facilities. It is required to validate receipt of the product and to complete the PRE-ALERT.
  9. PRE-ALERT SERVICE: the mandatory notification the CUSTOMER must submit through their account ("My Mailbox"), providing the identification, contents, and declared value of their shipments prior to arrival.
  10. WAYBILL NUMBER: the unique, non-repeatable number YEO CARGO LLC assigns to each package once received, linked to the pre-alerted tracking number.
  11. POD (PROOF OF DELIVERY) OR COMMERCIAL INVOICE: the receipt the CUSTOMER signs upon receiving their merchandise, as evidence of satisfactory receipt. YEO CARGO LLC may request additional documents evidencing the identity of the recipient.
  12. DELIVERY SERVICE: the home-delivery service for products purchased by the CUSTOMER.
  13. CIF VALUE: the value used by the destination country's customs authorities (for example, SENIAT in Venezuela) as the basis for calculating taxes, determined by the cost of the merchandise, the declared value, and the freight amount.
  14. FOREIGN CURRENCY: any currency other than the legal tender of the destination country, including securities denominated or payable in foreign currency.
  15. REFUND: the restitution of the monetary value invested by the CUSTOMER, provided the CUSTOMER completed the PRE-ALERT and that amount matches the purchase order and proof of payment; the refund will be issued as a credit balance to the customer's mailbox account to be used toward future shipments.
  16. AUDIT: an examination YEO CARGO LLC performs on a shipment or set of packages to verify its condition, availability, and status.
  17. DECLARED VALUE: the amount declared by the CUSTOMER that determines YEO CARGO LLC's limitation of liability as a carrier in the event of loss, disappearance, or total theft of the shipment, in accordance with the levels established in this document. It does not constitute an insurance contract.
  18. ABANDONMENT: the voluntary waiver, or waiver upon expiration of a deadline, of the CUSTOMER's ownership rights over their merchandise in favor of YEO CARGO LLC.
  19. STORAGE: the activity of holding and safeguarding packages owned by CUSTOMERS that are not in transit, within YEO CARGO LLC's warehouses or those of its logistics partners.
  20. CONSOLIDATION AND REPACKAGING: the combination of multiple packages with different waybill and tracking numbers into the smallest possible number of boxes, to be shipped to the final recipient under a single freight charge.
  21. ABANDONED CARGO: cargo not claimed by the CUSTOMER once the period established in the "Storage and Abandonment" section of this document has elapsed.
  22. INTERMEDIATE TRANSPORTATION OPERATOR / LOGISTICS PARTNER: a ground carrier, freight consolidator, licensed operator, or last-mile agent, other than YEO CARGO LLC, that participates in one or more stages of the shipment's transportation.

CHAPTER I β€” GENERAL FRAMEWORK, ACCEPTANCE, AND EFFECTIVE DATE

The Terms and Conditions contained in this document constitute a binding adhesion contract for the CUSTOMER. YEO CARGO LLC may modify these Terms periodically to reflect changes in its practices, applicable regulations, or operational reasons; the current version will be posted on the WEBSITE together with its effective date, and the CUSTOMER will be notified of material changes when reasonably possible. Continued use of YEO CARGO LLC's services on or after the effective date of an update constitutes acceptance of the revised Terms.

By receiving a shipping waybill digitally and/or in physical form, completing registration on the WEBSITE, or otherwise using YEO CARGO LLC's services, the CUSTOMER certifies that such acceptance is fully legally valid and constitutes their express consent to these Terms and Conditions. The CUSTOMER acknowledges that consent expressed electronically or digitally β€” including a confirmation click, acceptance of a digital waybill, or any other electronic means β€” constitutes a valid and binding signature under the Electronic Signatures in Global and National Commerce Act (the "ESIGN Act," 15 U.S.C. Β§ 7001 et seq.) and the Uniform Electronic Transactions Act (UETA) as adopted by the State of Tennessee, with the same legal force and effect as a handwritten signature.

The following address is established as YEO CARGO LLC's special domicile: 1219 Hilton Rd Ste H, Knoxville, TN 37921, United States.

Governing Law and Jurisdiction

This document is governed by and construed in accordance with the laws of the State of Tennessee, United States of America, without giving effect to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms and Conditions that is not subject to the arbitration procedure set forth below will be resolved exclusively before the state or federal courts of competent jurisdiction located in Knox County, Tennessee, and the CUSTOMER expressly consents to the personal jurisdiction of such courts. With respect to interstate transportation within the United States, applicable federal transportation law will additionally apply (including the Carmack Amendment, 49 U.S.C. Β§ 14706), which will prevail over any conflicting state provision.

Arbitration and Dispute Resolution

Any dispute, claim, or controversy related to these Terms and Conditions or to the services provided by YEO CARGO LLC will be resolved through binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not through a jury trial or class action. The CUSTOMER and YEO CARGO LLC expressly waive their right to participate in a class or consolidated action related to these Terms. Notwithstanding the foregoing, either party may bring a qualifying dispute in small claims court.

The CUSTOMER may opt out of this arbitration agreement by sending written notice within thirty (30) days of accepting these Terms to hola@yeocargo.com or to YEO CARGO LLC, 1219 Hilton Rd Ste H, Knoxville, TN 37921, United States, stating their full name, their shipment or account details, and their intent not to be bound by this clause.

Sanctions and Export Control Compliance

The CUSTOMER represents and warrants that neither they nor the recipient of the merchandise appear on any list of persons or entities blocked, restricted, or sanctioned by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the U.S. Department of Commerce (BIS), or any other competent authority, and that the shipment is not intended, directly or indirectly, to benefit such persons or entities, nor to violate any applicable U.S. sanctions or export control law or regulation. YEO CARGO LLC reserves the right to suspend, hold, refuse, or cancel any shipment, with no liability whatsoever to the CUSTOMER, where there is reasonable suspicion that such shipment could violate applicable sanctions or export control laws.


CHAPTER II β€” SCOPE OF SERVICE

YEO CARGO LLC will be responsible for transporting, from its origin facilities to the registered commercial agencies or the address chosen by the CUSTOMER, cargo and parcels resulting from purchases, acquisitions, or exchanges of goods with INDEPENDENT SELLERS OR EXTERNAL SUPPLIERS, or shipped directly by the CUSTOMER through its services. YEO CARGO LLC expressly states that it is not a supplier of goods or products of any kind, and has no economic, proprietary, or legal relationship with INDEPENDENT SELLERS OR EXTERNAL SUPPLIERS; accordingly, it will not be liable for manufacturing defects, quality, quantity, condition, packaging, or other warranties that are the responsibility of such suppliers.

The CUSTOMER acquires goods or products from INDEPENDENT SELLERS OR EXTERNAL SUPPLIERS at their own risk; YEO CARGO LLC will accept the transportation of such goods from its origin facilities to Venezuela, Colombia, or other destinations it offers, without assuming warranties that are the exclusive responsibility of the INDEPENDENT SELLER OR EXTERNAL SUPPLIER.

Use of Third-Party Licensed Operators and Partners

YEO CARGO LLC acts as an intermediary and freight consolidator, and does not directly operate vessels or aircraft, nor does it itself perform international sea or air transportation. To provide its services, YEO CARGO LLC uses the services of ground carriers, consolidators, and third-party agents β€” including intermediate transportation operators duly registered or licensed with the relevant authorities (including, as applicable, the Federal Maritime Commission and the Transportation Security Administration), as well as last-mile logistics partners in the destination country.


CHAPTER III β€” MANDATORY REGISTRATION

Registration is the voluntary act by which an individual accesses the WEBSITE with the intent to enter into this adhesion contract, accepting all of its provisions in full. This contract, once accepted, constitutes the law between the parties and is not revocable except by mutual agreement or under the grounds for termination provided in this document.

The CUSTOMER must provide true, accurate, correct, current, and complete identification information, and keep it updated at all times. If the CUSTOMER is a minor, they must provide, mandatorily at the time of registration, their legal representative's information.

If the CUSTOMER provides false, inaccurate, outdated, or incomplete information, or if YEO CARGO LLC has reasonable grounds to suspect that such information is untrue, YEO CARGO LLC may close the account and deny its use for security reasons.

Upon registration, YEO CARGO LLC will assign the CUSTOMER a personal, non-transferable mailbox number, which may not be used for commercial purposes. The CUSTOMER is responsible for keeping their membership number and password confidential, as well as for all activity conducted through their use, releasing YEO CARGO LLC from liability to third parties. The CUSTOMER agrees to notify YEO CARGO LLC immediately of any unauthorized use of their account.

YEO CARGO LLC will guarantee the privacy and confidentiality of the CUSTOMER's information in accordance with YEO CARGO LLC's Privacy Policy, available at https://yeocargo.com/policies/privacy-policy, unless a judicial authority or competent investigative body requests such information in the exercise of its functions.


CHAPTER IV β€” GENERAL SHIPPING SERVICE CONDITIONS

YEO CARGO LLC may manage, at the CUSTOMER's own expense and risk, the payment of nationalization taxes owed on products the CUSTOMER purchased abroad, provided such products are not among the items prohibited under the destination country's laws; such amounts will be reflected on the corresponding invoice, pursuant to the authorization granted by the CUSTOMER in the "Authorization to Manage Customs Payments" section of this document.

The CUSTOMER releases YEO CARGO LLC from all liability if the INDEPENDENT SELLER OR EXTERNAL SUPPLIER delivers mixed, incorrect, incomplete, or improperly identified shipments, or fails to include the corresponding mailbox number or tracking number.

If the CUSTOMER mistakenly receives a package that does not belong to them, they must notify YEO CARGO LLC and return it immediately, without opening the box, within a maximum of three (3) days from YEO CARGO LLC's formal notice requesting its return. Failure to return the package will not exempt YEO CARGO LLC from pursuing applicable legal action or from providing the affected customer's relevant identification information.

YEO CARGO LLC is not responsible for damage to or loss of fragile merchandise that is not properly packaged for export, for physical or internal damage to merchandise, boxes exceeding the recommended weight, or merchandise that has not been properly packaged. YEO CARGO LLC may notify the CUSTOMER so that they may file the corresponding claim with their INDEPENDENT SELLER OR EXTERNAL SUPPLIER.

Upon receiving the package, if it shows damage from transport, the CUSTOMER may inspect its contents in the presence of a YEO CARGO LLC representative; if satisfied, they will sign the Proof of Delivery (POD) or Commercial Invoice, at which point YEO CARGO LLC's liability for the package ends. YEO CARGO LLC will not be liable for packages whose receipt documentation lacks the signature of one of its operators or affiliates at the origin offices.

Customs Inspection and Compliance Verification

The CUSTOMER acknowledges that, pursuant to applicable international transportation treaties (including, as applicable, the regulations of the International Air Transport Association β€” IATA) and each country's customs laws, merchandise is subject to inspection by customs authorities in the country of origin or destination. YEO CARGO LLC may, in certain cases, open packages transported from the United States for the sole purpose of verifying that their contents fall within permitted import items, securely resealing the package once reviewed. Any claim regarding seals placed by EXTERNAL SUPPLIERS will be deemed invalid if YEO CARGO LLC's own seal or securing method was not tampered with.

This inspection authority is limited exclusively to verifying compliance with applicable import regulations; it does not, under any circumstance, mean that YEO CARGO LLC verifies, checks, or guarantees the condition, quality, quantity, status, or characteristics of the package's contents relative to what the CUSTOMER purchased. Unless the CUSTOMER has contracted an additional inspection and/or repackaging service previously authorized by the company, any claim related to missing, incorrect, or mismatched inventory must be handled directly with the corresponding INDEPENDENT SELLER OR EXTERNAL SUPPLIER.

Where there is a well-founded suspicion regarding a package's contents, YEO CARGO LLC may open it to verify that it does not contain merchandise prohibited from import, reporting to the relevant law enforcement and regulatory bodies if its illicit nature is confirmed, and providing the CUSTOMER's necessary information to the competent authorities when required.


CHAPTER V β€” SHIPMENTS TO VENEZUELA

  • It is illegal to omit items or provide false information, particularly regarding electronics and/or for commercial purposes.
  • For air shipments, it is prohibited to ship cell phones, tablets, and laptops together with other products; only one (1) electronic device with its charger is permitted per waybill.
  • For sea shipments, only one (1) electronic device is permitted per waybill and may be mixed with other items; two (2) or more electronic devices on the same waybill will incur additional charges that the CUSTOMER must pay, without exception.
  • Any shipment whose value exceeds USD $100.00 is subject to taxes. Venezuelan customs may impose taxes, fines, and/or additional charges even if the declared value is lower, if it determines there has been undervaluation, commercial content, or prohibited or misclassified items. The CUSTOMER must pay all taxes, fines, surcharges, and adjustments imposed by the customs authority, without exception.
  • Any import entering Venezuelan territory is subject to taxes determined based on the CIF value (merchandise, declared value, and freight), in accordance with the special laws and regulations governing customs and import activity.

The CUSTOMER understands and agrees that, if their shipment contains prohibited, misdeclared, or restricted items, the customs authority may hold or seize the merchandise in its entirety, with no right to claim, refund, or compensation from YEO CARGO LLC.

Items Prohibited for Import into Venezuela

The following are considered prohibited for import, among others: alcoholic beverages; perfumes; cosmetics; medicines and drugs, prescription (including CBD) or over-the-counter; chemical products; seeds; electronic cigarettes (vapes); cryptocurrency mining machines; securities, cash, traveler's checks, credit/debit cards, and documents; used or refurbished electronic items; tobacco; gold jewelry and high-value items (works of art, precious stones); live or dead animals, untreated hides, and natural plants; firearms or their components, knives, blades, ammunition, air or paintball guns, and replicas; ball bearings and bearings; ski masks and helmets of any kind; gas masks; slingshots; leather work gloves; fishing weights; canes; safety glasses; baseball/softball bats and balls; vehicle oils and batteries; drones; antacids/Neosporin; counterfeit ("pirated") goods; pornographic material; compressed gases, flammable items, spray paint, tear gas, and pressurized aerosols; toxic, corrosive, or oxidizing products; matches; and medical instruments and glassware. Shipping more than three items of the same category in a single box will be considered an import for commercial purposes.

These prohibitions reflect policies established under Venezuelan law; YEO CARGO LLC likewise may not transport such items and is not responsible for their seizure or confiscation by the competent authorities.


CHAPTER VI β€” SHIPMENTS TO COLOMBIA

  • It is prohibited to ship cell phones, tablets, and laptops together with other products; one (1) device may be shipped exclusively with its charger per waybill.
  • Under the courier mode, shipments valued at more than $200.00 are subject to taxes, which the CUSTOMER must pay.
  • Under the courier mode, no more than six (6) units of the same type may be shipped, nor items with a commercial appearance.
  • Colombia's National Tax and Customs Directorate (DIAN) may change the shipment's mode, hold or seize it, or classify it as commercial even if the CUSTOMER declares it personal. In such cases, the CUSTOMER must retain a customs agency in Colombia and bear all charges, taxes, and procedures for the release of the shipment; YEO CARGO LLC does not provide customs brokerage services.
  • Any shipment reassessed by the DIAN will incur an administrative fee of $20.00 per waybill, in addition to the corresponding tax for its release; processing, release, and delivery time will be extended by approximately 15 to 21 days.

The CUSTOMER understands and agrees that, if their shipment contains prohibited, misdeclared, or restricted items, the customs authority may hold or seize the merchandise in its entirety, with no right to claim, refund, or compensation from YEO CARGO LLC.


CHAPTER VII β€” DECLARATION OF VALUE, PRE-ALERT, AND TAX PAYMENT

The PRE-ALERT SERVICE must be completed by the CUSTOMER as a mandatory step through their account ("My Mailbox"), providing the identification, description, contents, and true value of the goods shipped. United States law and the laws of the destination countries establish express limitations and prohibitions on the shipment of certain goods; any violation by the CUSTOMER will be their sole and exclusive responsibility. The CUSTOMER must declare the true value of the acquired goods in the pre-alert, in order to make the corresponding customs declarations and, if applicable, for purposes of the declared-value level purchased. Omission or false declaration will not be attributable to YEO CARGO LLC. In the event of any issue with their shipment, only the amount pre-alerted by the CUSTOMER will be recognized.

I acknowledge that all taxes, duties, storage fees, adjustments, fines, or charges generated at destination are the sole responsibility of the sender and/or recipient, and must be paid in full for the merchandise to be released, without exception. Customs may generate taxes arbitrarily, even if the declared value is below USD $100.00, and may reclassify the shipment as commercial, generating additional taxes that the CUSTOMER must also pay. YEO CARGO LLC will not cover or absorb any charge resulting from customs decisions.

YEO CARGO LLC will not accept claims for incorrectly declared values, whether intentional or not on the part of the CUSTOMER, if the item was not previously pre-alerted. If it was pre-alerted, YEO CARGO LLC will request the commercial invoice or purchase order and proof of payment to verify that it matches the declared value. If the value declared in the pre-alert is lower than that shown on the commercial invoice, the value declared by the CUSTOMER will be used for purposes of any claim.

Authorization to Manage Customs Payments

I expressly authorize YEO CARGO LLC to make, without prior consultation, payment of taxes, duties, or additional charges whenever possible, necessary, and appropriate to release my cargo. I agree to reimburse such payments within a maximum of five (5) business days, accepting a penalty of USD $5.00 for each day of delay in the event of late payment. While any debt remains outstanding, my cargo will remain held with no possibility of delivery.


CHAPTER VIII β€” DECLARED VALUE (CARRIER'S LIMITATION OF LIABILITY)

YEO CARGO LLC acts as the carrier and consolidator of the merchandise it receives for shipment. YEO CARGO LLC's maximum liability in the event of loss, disappearance, or total theft of the box/package is determined by the value declared by the CUSTOMER at the time their shipment is received, in accordance with the levels below. This section does not constitute, and should not be interpreted as, an insurance contract; it is the contractual limitation of liability assumed by YEO CARGO LLC as the carrier with respect to the shipment.

Default released value (no value declared): If the CUSTOMER does not declare a higher value, YEO CARGO LLC's maximum liability in the event of loss, disappearance, or total theft of the box will be USD $1.00 per pound shipped, up to a maximum of USD $100.00 per waybill, at no additional charge. This amount will be issued as a credit balance to the customer's mailbox account for the payment of future shipments.

Declared-value levels (optional, with a valuation charge):

Level 1 β€” Valuation charge: USD $5.00 per box. Maximum declared value: USD $100.00. Applies to: total loss, disappearance, or theft of the box only. Requirements: a commercial invoice is not required. Exclusions: does not cover damage, breakage, fragile items, partial shortages, customs seizures, or misdeclared merchandise.

Level 2 β€” Valuation charge: USD $10.00 per box. Maximum declared value: USD $200.00. Same conditions, requirements, and exclusions as Level 1.

Level 3 β€” Full Coverage β€” Valuation charge: 10% of the declared value. Maximum liability: up to 100% of the declared value. Applies to: partial or total losses, or provable theft, subject to evaluation. Mandatory requirements: original invoice for the contents, mandatory inspection prior to shipment, adequate packaging, and clear photographic and documentary evidence of the loss or theft. Exclusions: does not cover damage, breakage, fragile items, customs seizures, or misdeclared merchandise.

Level 4 β€” Electronic Equipment β€” Valuation charge: 20% of the declared value. Maximum liability: up to 100% of the declared value. Same mandatory requirements and exclusions as Level 3, specifically applied to electronic equipment.

Absolute limitation of liability without a declared value: If the CUSTOMER does not declare a value, fails to provide an invoice, or fails to meet the requirements for the declared-value level they chose, YEO CARGO LLC will have no obligation whatsoever to indemnify, reimburse, or compensate the CUSTOMER beyond the default released value. In such cases, any additional compensation will be exceptional, discretionary, and non-binding, and will not constitute a precedent. Under no circumstances will YEO CARGO LLC reimburse costs incurred in paying freight charges to the shipping line, airline, and/or their transportation partners, but only the value of the package in accordance with the declared-value level purchased. The corresponding amount will be issued as a credit balance to the customer's mailbox account for the payment of future shipments.

For the home-delivery (Delivery) service, YEO CARGO LLC's liability is considered limited to the pre-alerted amount only if the CUSTOMER pre-alerted and prepaid for the corresponding declared-value level. If a claim is approved, the CUSTOMER will be reimbursed the corresponding amount as a credit balance in their mailbox account for future shipments.

Liability on the Domestic Leg (Carmack Amendment)

For shipments that include a leg of interstate ground transportation within the United States, YEO CARGO LLC's liability for loss or damage will be governed by the Carmack Amendment (49 U.S.C. Β§ 14706) and its implementing regulations. YEO CARGO LLC offers the CUSTOMER, prior to dispatch of their shipment, the option to declare the value of their merchandise subject to payment of the corresponding valuation charge as set forth in this section; if the CUSTOMER does not declare a value, the default released value will apply.

Any claim for loss or damage occurring during the interstate ground leg will be governed by the minimum time limits established under the Carmack Amendment, as applicable to the type of loss or damage reported. For air transportation, sea transportation, and delivery in the destination country, the CUSTOMER must report any issue within the time frame established in the "Verification, Incidents, and Claims" section of this document, as those legs are governed by different regulations (including, as applicable, the international air transportation regime referenced in Chapter XII, the Carriage of Goods by Sea Act (COGSA), and the customs and transportation laws of the destination country).


CHAPTER IX β€” SPECIAL SERVICES

1. Consolidation

When the CUSTOMER purchases multiple products from one or more INDEPENDENT SELLERS OR EXTERNAL SUPPLIERS and these are delivered to YEO CARGO LLC, multiple packages will be consolidated into a single shipment, provided the CUSTOMER requests this from their mailbox account. To do so, the CUSTOMER will log into their mailbox, select the corresponding tracking numbers, indicate the declared value of each, and select the shipping method. Once the method is selected and the value declared, the CUSTOMER will receive their invoice and may view the details from the "My Invoices" module.

Each tracking number must be reported individually. From the arrival of the first tracking number, a maximum period of seven (7) consecutive days will begin for the remaining orders en route to the CUSTOMER's mailbox to be received. If this period elapses without the remaining tracking numbers having arrived, the packages received up to that point will be invoiced and shipped by the most economical method.

2. E-Shopper Service

The E-Shopper service has a flat fee of $15.00, regardless of the purchase amount. To use it, the CUSTOMER must provide YEO CARGO LLC with the login details for the external supplier's platform on which they wish to shop, and will be responsible for selecting products and adding them to the shopping cart within the chosen platform. YEO CARGO LLC will not be liable for any order incorrectly prepared by the external supplier, whether due to quantities, missing pieces, different sizes or colors, or any other irregularity; nor is it liable for delays in receiving orders caused by USPS, UPS, FedEx, or other carriers, or for fragile merchandise that is poorly packaged or boxes that exceed their supportable weight.

3. Home Delivery Service (Delivery)

A CUSTOMER wishing to use this service must register and keep their delivery address up to date in their mailbox. The CUSTOMER or the person authorized to receive the merchandise agrees to inspect the contents of the package in the presence of the delivery personnel; no subsequent claims for breakage, dents, missing items, or other defects attributable to the handling of the package will be accepted. YEO CARGO LLC's role is limited to providing the transportation service, and it does not provide warranties on goods purchased by the CUSTOMER from EXTERNAL SUPPLIERS or on the contents of the package.

The cost of the home-delivery service will depend on the destination zone. If the address is located in an area not served for logistical or occupational safety reasons, YEO CARGO LLC will contact the CUSTOMER to arrange pickup at the nearest point outside that zone. The service will be attempted once; if it cannot be completed successfully, the shipment will be returned to one of our locations and the CUSTOMER must arrange for pickup, or request the service again subject to applicable charges.

The Delivery service operates Monday through Friday, excluding holidays, from 9:00 a.m. to 5:00 p.m., and may be subject to change due to store closures, holidays, strikes, weather conditions, natural disasters, access restrictions, or other circumstances, which will be communicated to the CUSTOMER in a timely manner.


CHAPTER X β€” PACKAGE PICKUP AT COMMERCIAL AGENCIES

When picking up their package at the chosen location, the CUSTOMER must present their national ID card (or other valid identification document) and the waybill number or warehouse receipt evidencing that they are the mailbox holder or the shipment's beneficiary.

If a third party appears on behalf of the CUSTOMER, they must present an authorization issued exclusively for that request, submitted at least three (3) days prior to pickup, explicitly stating the waybill(s) to be picked up, accompanied by: (i) a printed and signed authorization, (ii) a copy of the identification documents of both the CUSTOMER and the authorized person, and (iii) the pro forma invoice(s) to be picked up. By authorizing a third party, the CUSTOMER releases YEO CARGO LLC from all liability for packages picked up by that person.

The CUSTOMER or the authorized person agrees to inspect the contents of the package in the presence of the delivery personnel; no subsequent claims regarding the physical condition of the contents will be accepted.

In the event of the CUSTOMER's death, their legally verified heirs may pick up the goods stored under the deceased's name by presenting: identification, a death certificate, and a declaration of sole and universal heirs issued by the competent authority in accordance with applicable law.


CHAPTER XI β€” RATES AND CHARGES

YEO CARGO LLC's international service rates are determined based on the classification of the merchandise, and may be charged in the currency of the country of origin or destination.

Low-value merchandise: items with a commercial value between USD $0.01 and USD $100.00. International freight will be charged based on a minimum shipping price plus an additional price per pound or cubic foot depending on the shipping method chosen, in addition to applicable valuation charges (where applicable), air fuel surcharge, storage, postage, customs, and applicable taxes.

High-value merchandise: items with a commercial value between USD $100.01 and USD $2,000.00 (including the sum of consolidated items in a single box that exceeds that amount). The same charge categories apply as for low-value merchandise.

For air shipments, YEO CARGO LLC charges the greater of actual weight or volumetric weight, calculated using the industry-standard formula: (Length x Height x Width in inches) Γ· 166 = volumetric weight in pounds.

YEO CARGO LLC will apply storage charges once the established timeframes for the CUSTOMER's pickup and delivery of merchandise have been exceeded, in accordance with the "Storage and Abandonment" section of this document.

YEO CARGO LLC reserves the right to modify and adjust its rates and fuel surcharge when circumstances warrant, which will be published on the WEBSITE, on social media, and/or on notice boards at its agencies, publicly and with reasonable advance notice in accordance with applicable regulations.


CHAPTER XII β€” DELIVERY CONDITIONS, DELAYS, AND FORCE MAJEURE

Delivery times are approximate and begin counting from the actual departure of the shipment from Miami (not from the receipt of cargo at our main and/or affiliate offices):

  • Air shipments to Venezuela: 10-15 business days depending on the delivery zone. Sea shipments: 6-8 weeks.
  • Air shipments to Colombia: 10-15 business days depending on the delivery zone.

Changes to the address, recipient, and/or delivery information will incur an additional charge of $15.00 per waybill. Door-to-door delivery is not guaranteed in rural areas, areas that are difficult to access, high-risk areas, or areas with route or transportation issues; in such cases, the recipient must coordinate with our staff to receive the merchandise at an agreed and previously authorized location.

YEO CARGO LLC will not be liable for delays, disruptions, or losses caused by, among others: customs inspections or government holds; internal customs processes; weather conditions (rain, storms, hurricanes, earthquakes, floods); natural disasters; the closure of ports, airports, or roads; strikes, civil unrest, or third-party logistics failures; incorrect or incomplete information provided by the CUSTOMER or the EXTERNAL SUPPLIER at the time of pre-alert; delays by the carrier hired by the EXTERNAL SUPPLIER prior to arrival at YEO CARGO LLC's receiving offices; failure to timely pay freight or fees; warranties or manufacturing defects attributable to the EXTERNAL SUPPLIER; and general acts of God or force majeure, including acts of public enemies, detention by sovereign authority, quarantine restrictions, strikes, riots, terrorism, declared or undeclared war or armed conflict, nuclear fission or fusion, and ionizing radiation or radioactive contamination.

If the transportation of a shipment involves a final destination or stopovers in a country other than the country of departure, the applicable international air transportation regime will apply β€” including, as applicable, the 1929 Warsaw Convention, the 1955 Hague Protocol, the 1975 Montreal Protocol, and the 1999 Montreal Convention β€” for purposes of YEO CARGO LLC's liability in international air transportation.


CHAPTER XIII β€” VERIFICATION, INCIDENTS, AND CLAIMS

Yeo Cargo receives and processes packages in the same condition in which they are delivered by the customer, logistics providers, and/or online retailers. Unless the CUSTOMER has contracted an additional inspection and/or repackaging service previously authorized, YEO CARGO LLC does not verify the contents, quantity, model, size, color, or condition of the items received. Any claim related to damaged packages, missing or incorrect products, or inventory discrepancies must be handled directly with the EXTERNAL SUPPLIER, the party responsible for transportation, or the party responsible for the contents' inventory.

In the event of any incident, the CUSTOMER must report, within twenty-four (24) hours of receiving their shipment in the final destination city, any issue, anomaly, or condition regarding the status of their shipment. Once the report is received, YEO CARGO LLC may open an investigation following its established protocols, the response time for which may range from 21 to 30 business days, given that YEO CARGO LLC works directly and indirectly with affiliated companies and logistics and transportation operators whose stages must be investigated both internally and externally.

Once delivery has taken place and the package has been inspected in the presence of YEO CARGO LLC or its logistics partners' personnel, no subsequent claims for missing items, losses, or damage not noted at that time will be accepted.

Refund Process for Loss or Disappearance

For shipments handled through the virtual mailbox (purchases from EXTERNAL SUPPLIERS), YEO CARGO LLC will only process refunds for packages that were pre-alerted, had their commercial value declared, and, if applicable, had the corresponding declared-value level purchased prior to the shipping date. For shipments made directly from YEO CARGO LLC's locations without using a virtual mailbox, only the declaration of value and, if applicable, the declared-value level purchased prior to shipment will be required.

To request a refund, the CUSTOMER must notify YEO CARGO LLC of the loss or disappearance of their package and, within three (3) consecutive days of such notice, submit the corresponding purchase order or, in the case of shipments not using a virtual mailbox, proof of the declared value of their merchandise. Once this information is received, YEO CARGO LLC will have thirty (30) business days to search its system, confirm compliance with the pre-alert and value declaration requirements, and conduct the relevant physical search and investigation before declaring the merchandise lost.

Once the investigation is complete and YEO CARGO LLC's liability is established, the company will declare the loss and will have an additional thirty (30) business days, plus a fifteen (15) day extension, to issue the corresponding refund as a credit balance to the CUSTOMER's mailbox account, applicable to future shipments, for the value of the item in accordance with the declared-value level purchased.

CHAPTER XIV β€” STORAGE AND ABANDONMENT

Once merchandise is received at one of our locations or affiliate offices, it will be stored temporarily and shipped weekly to its destination under the method previously chosen by the CUSTOMER. If, as of the date of receipt, there is no record of a chosen shipping method or declared value, the package will be shipped to its destination and invoiced under the most economical shipping method, with the default released value applied. Once the invoice is issued, the CUSTOMER will have three (3) consecutive days to arrange payment to avoid unnecessary charges for late payment, customs processes, and/or storage at destination.

For merchandise and shipments to destinations where the full invoiced freight must be prepaid before shipment, the package will be stored temporarily, and it will not be shipped to its final destination until payment of the freight is received. Beginning on the seventh (7th) day after receipt, a daily storage fee starting at $1.00 will apply, varying according to the shipment's dimensions and/or weight.

Abandonment: if three (3) days from the issuance of the invoice, plus sixty (60) additional days (a total of sixty-three (63) consecutive days from the invoice's issuance), elapse without the CUSTOMER having indicated an intent to pay, the merchandise will enter abandoned status. YEO CARGO LLC will declare the merchandise ABANDONED and may use it for the corresponding purposes to cover costs incurred for freight, taxes, and/or other charges. By this condition, the CUSTOMER assumes the intent to abandon their cargo, and YEO CARGO LLC is released from any liability for costs incurred in processing the merchandise.


CHAPTER XV β€” LIMITATION OF LIABILITY AND GENERAL DISCLAIMER

YEO CARGO LLC is not liable for delays or failure to deliver caused by incorrect information provided by the CUSTOMER (address, email, phone number), nor for errors made by carriers hired by the EXTERNAL SUPPLIER prior to arrival at our warehouses. Nor is it liable for packages held by customs, whether at origin or destination.

YEO CARGO LLC is not liable for damages resulting from inaccuracy, incompleteness, or outdated information on its WEBSITE, and does not guarantee the availability or continuous operation thereof; to the fullest extent permitted by applicable law, it disclaims liability for damages resulting from the unavailability of the site or its online services, as well as for the disclosure of confidential information resulting from cyberattacks beyond its reasonable control.

The CUSTOMER agrees to defend, indemnify, and hold harmless YEO CARGO LLC, its providers and affiliated third parties, and its officers, representatives, and employees, from any claim, loss, expense, or cost β€” including attorneys' fees β€” arising from the use of YEO CARGO LLC's services, or from the CUSTOMER's or any user of their account's violation of these Terms.

YEO CARGO LLC is not responsible for the contents or packaging of the package, nor does it cover damage caused by inadequate packaging; such claims must be directed to the corresponding EXTERNAL SUPPLIER. YEO CARGO LLC does not perform packaging, repackaging, or consolidation of merchandise unless the CUSTOMER has expressly contracted such a service.

Scope of Disclaimers and Limitations of Liability

Nothing in this document releases YEO CARGO LLC from liability for fraud, gross negligence, or willful breach of its own obligations under these Terms. The disclaimers and limitations of liability established herein apply to the fullest extent permitted under applicable law of the State of Tennessee and the United States.


CHAPTER XVI β€” GROUNDS FOR TERMINATION

YEO CARGO LLC may terminate this contract in, among others, the following cases: the CUSTOMER's death; the provision of false, inaccurate, or outdated information; demonstrably abusive or degrading treatment of YEO CARGO LLC personnel; commercialization of the mailbox, which is for non-transferable use; repeated abandonment of packages; the commission of a criminal act fully verified by the competent authorities in connection with use of the mailbox; the CUSTOMER's duplication or multiple use of mailboxes; violation of applicable law or of standards of good conduct applicable to civil and commercial contracts; repeated shipment of prohibited, restricted, harmful, or polluting products; and repeated accumulation of packages in our warehouses.

We also reserve the right to cancel or suspend the mailbox and/or refuse to receive and ship merchandise for customers who use the service for purposes other than those stipulated, including making online purchases with third-party credit/debit cards without the cardholder's prior consent, making false statements about the contents, or filing claims or incidents without supporting documentation.


CHAPTER XVII β€” PRIVACY AND COMMUNICATIONS

The processing of the CUSTOMER's personal information is governed by YEO CARGO LLC's Privacy Policy, available at https://yeocargo.com/policies/privacy-policy, which forms an integral part of these Terms and Conditions. By providing their phone number and/or email address, the CUSTOMER expressly consents to receive operational and, where applicable, promotional communications by email, WhatsApp, and/or text message related to their shipments and to YEO CARGO LLC's services.

The CUSTOMER may revoke their consent to promotional communications at any time by replying "BAJA" or "STOP," or by emailing hola@yeocargo.com, without affecting the operational communications necessary to provide the service.


CHAPTER XVIII β€” ACCEPTANCE AND FINAL PROVISIONS

By completing their registration, accepting a shipping waybill, or otherwise using YEO CARGO LLC's services, the CUSTOMER accepts these Terms and Conditions in their entirety, as set forth in this document. This agreement is the law between the parties and will govern the relationship between YEO CARGO LLC and the CUSTOMER.
